Mobile Messaging Terms and Conditions 

TheOnlineMan (hereinafter referred to as "We," "Us," or "Our") offers a mobile messaging program (the “Program”), which you choose to use and participate in, subject to the following Mobile Messaging Terms and Conditions and Privacy Policy (the “Agreement”). By opting into any of the Programs, you agree to be legally bound by these Terms and Conditions, as updated from time to time, and confirm that you have read and understood our Privacy Policy. 

This Agreement is specific to the Program and does not intend to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in different contexts. We reserve the right to modify or update this Agreement at any time, and your continued use of the Program after the effective date of any changes constitutes your acceptance of those changes. 

The Program enables Users to receive SMS mobile messages upon opting in, such as through online or application-based subscription forms. Your consent to receive automated marketing text messages is not mandatory for purchasing any goods or services. Irrespective of the opt-in method you used to enrol in the Program, this Agreement applies to your participation. 

If you have opted in, the Program provides updates, alerts, information, promotions, specials, and other marketing offers (e.g., product discounts) from TheOnlineMan through text messages sent to the mobile number you provided, using an automated telephone dialling system or other technology. Message frequency may vary. You are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

If you wish to discontinue participating in the Program or no longer agree to this Agreement, you can opt out by replying STOP to any mobile message from Us. You may receive an additional mobile message confirming your decision to opt out. Please note that these options are the only reasonable methods for opting out, and any other means, such as texting words other than those provided or verbally requesting removal from our list, are not considered reasonable methods.

You understand that any messages, including STOP requests, sent to a telephone number we have changed may not be received, and we will not be held responsible for honouring requests made in such messages. 

The wireless carriers supported by the Program are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number and to maintain accurate, complete, and up-to-date information related to your receipt of messages, including notifying us promptly if your mobile number changes. 

  • Indemnification and Liability 

You agree to indemnify, defend, and hold us harmless against any third-party claims, liabilities, damages, or costs that arise from your use of the Program or from providing us with a phone number that does not belong to you. If you intend to discontinue the use of the mobile telephone number used to subscribe to the Program, including cancelling your service plan or transferring the phone number to another party, you must complete the Opt-Out process as described above before ending your use of that mobile telephone number. Your commitment to this process is an essential part of these terms and conditions. 

Furthermore, if you change your telephone number without notifying Us of such change, you agree to be responsible for all costs, including attorneys' fees, and liabilities incurred by Us or any party assisting in the delivery of SMS mobile messages as a result of claims brought by the individuals later assigned that mobile telephone number. This obligation and agreement remain in effect even after you cancel or terminate your participation in any of our Programs. 

You acknowledge that we shall not be liable for any failed, delayed, or misdirected delivery of information sent through the Program, errors in such information, and any actions you may take or choose not to take in reliance on the information or Service. 

  • Age Restriction 

You are prohibited from using or engaging with the Platform if you are under the age of eighteen (18) years. By using or engaging with the Platform, you confirm and agree that you are not under the age of eighteen (18) years. Additionally, by using or engaging with the Platform, you acknowledge and agree that you are permitted to do so by the Applicable Law of your jurisdiction.

We may disclose your personal information if we are legally obligated to do so or if you breach our Terms of Service. Your privacy is important to us, and any disclosure will be made in accordance with applicable laws and regulations. 

SECTION 4 - Odoo

Our store is hosted on Odoo. They provide us with an online e-commerce platform that enables us to offer our products and services to you. Odoo stores your data in their data storage, databases, and the general Odoo application. Rest assured; your data is kept on a secure server protected by a firewall. 

Payment: If you opt for a direct payment gateway to complete your purchase, Odoo stores your credit card data. This data is encrypted in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). 

Your purchase transaction data is retained only for the necessary duration to fulfill your purchase transaction. Once the transaction is completed, your purchase transaction information is securely deleted. All direct payment gateways adhere to the standards set by PCI-DSS, managed by the PCI Security Standards Council—a collaborative effort of major brands such as Visa, MasterCard, American Express, and Discover. These requirements are in place to ensure the secure handling of credit card information by our store and its service providers.   • _session_id: This is a unique token that is sessional. It allows Odoo to store information about your session, such as the referrer and landing page. 
  • _odoo_visit: No data is held, and it is persistent for 30 minutes from the last visit. This cookie is used by our website provider's internal statistics tracker to record the number of visits. 
  • _odoo_uniq: No data is held, and it expires at midnight (relative to the visitor) of the next day. It counts the number of visits to a store by a single customer. 
  • cart: This is a unique token that is persistent for 2 weeks. It stores information about the contents of your cart. 
  • _secure_session_id: This is a unique token that is sessional. 
  • storefront_digest: This is a unique token with an indefinite duration. It is used to determine if the current visitor has access when the shop has a password. 

We provide you with the option to choose whether or not to opt out of cookies, depending on your preferences.
